For the first time in 1996, the South African Constitution included constitutional reference to Khoekhoe and San people. Article 6 (2) affirms: “Recognising the historically diminished use and status of the indigenous languages of our people, the state must take practical and positive measures to elevate the status and advance the use of these languages”. The majority of the languages recognized under apartheid were referred to as “indigenous”, which became the 11 official languages in 1994, but it however excludes the KhoeSan languages.

Nevertheless, a whole new constitutional period has been opened by recognizing the presence of Khoekhoe and San people and their endangered languages through article 6 (5) which indicates that “A Pan South African Language Board established by national legislation must promote, and create conditions for, the development and use of … the Khoe, Nama and San languages”.
